FIELD OF APPLICATION

The customer acknowledges that for business relations with us, Forty Five Mode OG, operating under the brand name Five Forty The Label, Domplatz 2, 9020 Klagenfurt am Wörthersee (in the following “Forty Five”) exclusively the Terms and Conditions (in the following “T&C”) layed out in the following, respectably in the version at the time of closing the contract, apply.

With the submission of an order, the customer agrees to these T&C and they become part of the sales contract.

These T&C apply to consumers as well as business customers. Provisions which are exclusively applicable to consumers or business customers are identifiable by the wording.

Provisions by the customer opposed to these T&C are not recognized. Actions on fulfilling the contract from Forty Five do not count as approval to opposing T&C.

CONCLUSION OF THE CONTRACT

The presentation of the products in this online shop does not represent a legally binding offer, but a non-binding online catalog. Placing an order with Forty Five represents an offer to Forty Five to conclude a purchase contract. The confirmation of the receipt of the order will be transmitted after sending the order. This confirmation on receipt of the order does not yet represent an acceptance of the contract. We agree upon concluding a sales contract with you by sending you an order confirmation by email or by delivering the goods.

WITHDRAWAL

You may exercise your right to withdraw from this contract within 14 days without giving any reason. The withdrawal period starts from the day on which you or a third party named by you who is not the carrier has taken possession of the goods. In order to cancel your contract, you have to inform Forty Five. Please find more information on your withdrawal here.

CONSEQUENCES OF YOUR WITHDRAWAL

Within a period of 14 working days from the moment we receive your package in our office, your refund will be arranged. For your reimbursement, we will use the same means of payment used by you in the original transaction unless agreed with you otherwise.

We can only accept the returned product unused and in our original packaging. You are liable for any loss in value of the goods which is due to your handling of the product which is not necessary to inspect its condition, properties, and functionality.

The costs for the return shipment as well as any related costs for importing the goods back to Austria have to be met by the customer.

DELIVERY

Orders are processed Monday through Friday, with the exception of federal holidays. Most orders are shipped within 3 business days of purchase. All orders include a tracking number, which will be sent to you as confirmation of the shipping.

Please note that all information on the shipping or delivery of a product is only approximate information and approximate guide values. They do not represent any binding or guaranteed shipping or delivery dates unless this is expressly designated as a binding date in the shipping options for the respective product.

PAYMENT

The customer may pay the purchase price with the available payment options given at the check-out. Payment must be made in the currency shown on the invoice.

PRICE

All prices are Euro prices and include the legal value-added tax. Delivery costs are listed separately.

RESERVATION OF TITLE

The delivered goods remain the property of Forty Five until they have been paid for in full. You have no right to resell, dispose or debit the item before the property has been passed over to you.

APPLICABLE LAW

For all contracts Austrian law is applicable.

WARRANTY

Should delivered products have obvious material or manufacturing defects including transport damage, please complain about such defects immediately to us. The omission of this complaint has no consequences for your legal claims.

If there is a defect in the purchased item, the statutory provision applies. If the supplementary performance has been carried out through a replacement delivery, the customer is obliged to return the products initially delivered within 14 days.

ELECTRONIC COMMUNICATION

The customer agrees that all contact-related communication can take place in electronic form.

ALTERNATIVE DISPUTE RESOLUTION

Forty Five is not obliged and unwilling to participate in dispute resolution proceedings before a consumer mediation body.
